The main problem of the Spanish local finance system derives from the existence of two opposite models: LOFCA model versus Floral system. As a result of this opposition, the Spanish system has moved some distance away from the theoretical principles of sound fiscal federalism. The analysis carried out in the article points out clearly the need to improve the fiscal mechanisms of responsibility and financial autonomy and to introduce a system of interjurisdictional responsibility which should palliate the defects detected in (...) the actual system in order to maximise the political and economic advantages of an authentic fiscal decentralisation.Le problème majeur du système espagnol de finances locales réside dans l’existence de deux modèles opposés: le modèle LOFCA et le système Floral. En raison de cette opposition, le système espagnol s’est considérablement écarté des principes affirmés par la théorie d’un authentique fédéralisme fiscal. L’analyse conduite dans l’article met en évidence la nécessité d’améliorer les mécanismes fiscaux de responsabilité et d’autonomie financière des collectivités locales espagnoles en introduisant un système de responsabilité inter-juridictionnelle capable d’éliminer les incohérences du système ; ce qui permettra de tirer pleinement partie des avantages politiques et économiques inhérents à la décentralisation fiscale. Climate change involves changes in the climate system caused by polluting human activities and the social and natural effects of these changes. The historical and anthropogenic grounds of climate change play an important role in climate justice claims. Many climate justice scholars believe that principles of climate justice should account for the historical and anthropogenic sources of climate change. Two main backward-looking principles have been proposed: the polluter pays principle (PPP) and the beneficiary pays principle (BPP). The BPP emerged in (...) the literature on climate justice in response to certain objections raised against the PPP. In this paper, I focus on two of these objections: the causation objection and the excusable ignorance objection. Defenders of the BPP have traditionally assumed that this principle is not vulnerable to those objections, which renders the BPP superior to the PPP. In this paper, I challenge this underlying assumption. My argument here is simple: moving from the PPP to the BPP in response to any of these objections might be unjustified because the BPP is affected by at least some of the considerations giving rise to these objections. Debates about individual responsibility for climate change revolve mainly around individual mitigation duties. Mitigation duties concern future impacts of climate change. Unfortunately, climate change has already caused important harms and it is foreseeable that it will cause more in the future, in spite of our best efforts. Thus, arguably, individuals might also have duties related to those harms. In this paper, I address the question of whether individuals are obligated to provide compensation for climate related harms that have already occurred. (...) I explore two possible strategies to answer that question. The straightforward strategy answers in the affirmative. Two approaches embrace this strategy: the ‘ecological citizenship’ approach and the benefits-based approach. I challenge those two approaches and rule out an affirmative answer. The alternative strategy answers in the negative but provides a way to respond to why currently living individuals should pay for burdens created for past individuals. Two possible approaches embrace this alternative: the community-based approach and my own state-based benefits approach. I will argue that individual duties do not fall under the realm of compensatory justice, but they have nonetheless a duty to bear compensatory burdens allocated to their states. (shrink)

The Polluter Pays Principle (PPP) states that polluters should bear the burdens as- sociated with their pollution. This principle has been highly contested because of the pu- tative impossibility of considering individuals morally responsible for an important amount of their emissions. For the PPP faces the so-called excusable ignorance objec- tion, which states that polluters were for a long time non-negligently ignorant about the negative consequences of greenhouse gas emissions and, thus, cannot be considered morally responsible for their negative consequences. (...) This paper focuses on the concept of moral responsibility as it appears in the excusable ignorance objection. I claim that this objection stems from a narrow notion of moral responsibility and that a more fundamen- tal notion of moral responsibility would pave the way to overcome it. I show that it should be out of the question whether historical polluters should bear some burdens asso- ciated with climate change because of their historical emissions. The relevant question is which kind of burdens they can legitimately be asked to bear. I argue that this notion of moral responsibility allows us to assign burdens of symbolic reparation, which are at the core of ‘Loss and Damage’ policies. (shrink)

I then argue that attempts to produce such examples are doomed to failure. In some medical cases there is a moral distinction between killing and letting die, but in others there is not. In this paper I present an original and principled account of the moral distinction between killing and letting die. The account provides both an explanation of the moral distinction and an explanation for why the distinction does not always hold. If these explanations are correct, the moral distinction between killing and letting die must be taken seriously in medical contexts. Defeasibly, (...) when an agent kills she takes responsibility, but when an agent lets die she does not take responsibility. Therein lies the moral distinction between killing and letting die. The distinction, however, is defeated when an agent is already responsible for the surrounding situation. In such cases, killing does not involve taking any further responsibility and letting die does not avoid taking any responsibility. Medical examples are frequently complicated because patients' autonomous choices impact upon medical practitioners' surrounding responsibility. (shrink)

Algorithmic predictions are promising for insurance companies to develop personalized risk models for determining premiums. In this context, issues of fairness, discrimination, and social injustice might arise: Algorithms for estimating the risk based on personal data may be biased towards specific social groups, leading to systematic disadvantages for those groups. Personalized premiums may thus lead to discrimination and social injustice. It is well known from many application fields that such biases occur frequently and naturally when prediction models are applied to (...) people unless special efforts are made to avoid them. Insurance is no exception. In this paper, we provide a thorough analysis of algorithmic fairness in the case of insurance premiums. We ask what “fairness” might mean in this context and how the fairness of a premium system can be measured. For this, we apply the established fairness frameworks of the fair machine learning literature to the case of insurance premiums and show which of the existing fairness criteria can be applied to assess the fairness of insurance premiums. We argue that two of the often-discussed group fairness criteria, independence (also called statistical parity or demographic parity) and separation (also known as equalized odds), are not normatively appropriate for insurance premiums. Instead, we propose the sufficiency criterion (also known as well-calibration) as a morally defensible alternative that allows us to test for systematic biases in premiums towards certain groups based on the risk they bring to the pool. In addition, we clarify the connection between group fairness and different degrees of personalization. Our findings enable insurers to assess the fairness properties of their risk models, helping them avoid reputation damage resulting from potentially unfair and discriminatory premium systems. The aim of this paper is to show that Graham Priest's dialetheic account of semantic paradoxes and the paraconsistent logics employed cannot achieve semantic universality. Dialetheism therefore fails as a solution to semantic paradoxes for the same reason that consistent approaches did. It will be demonstrated that if dialetheism can express its own semantic principles, a strengthened liar paradox will result, which renders dialetheism trivial. In particular, the argument is not invalidated by relational valuations, which were brought into paraconsistent logic (...) in order to avoid strengthened liar paradoxes. (shrink)

Climate scientists have proposed two methods to link extreme weather events and anthropogenic climate forcing: the probabilistic and the storyline approach. Proponents of the first approach have raised the criticism that the storyline approach could be overstating the role of anthropogenic climate change. This issue has important implications because, in certain contexts, decision-makers might seek to avoid information that overstates the effects of anthropogenic climate change. In this paper, we explore two research questions. First, whether and to what extent the (...) storyline approach overstates the effects of anthropogenic climate change. Second, whether the objections offered against the storyline approach constitute good reasons to prefer the probabilistic approach. Concerning the first question, we show that the storyline approach does not necessarily overstate the effects of climate change, and particularly not for the reasons offered by proponents of the probabilistic approach. Concerning the second question, we show, independently, that the probabilistic approach faces the same or very similar objections to those raised against the storyline approach due to the lack of robustness of climate models and the way events are commonly defined when applying the probabilistic approach. These results suggest that these objections might not constitute good reasons to prefer the probabilistic approach over the storyline approach. (shrink)

In this paper, we study the effects of using an algorithm-based risk assessment instrument (RAI) to support the prediction of risk of violent recidivism upon release. The instrument we used is a machine learning version of RiskCanvi used by the Justice Department of Catalonia, Spain. It was hypothesized that people can improve their performance on defining the risk of recidivism when assisted with a RAI. Also, that professionals can perform better than non-experts on the domain. Participants had to predict whether (...) a person who has been released from prison will commit a new crime leading to re-incarceration, within the next two years. This user study is done with (1) general participants from diverse backgrounds recruited through a crowdsourcing platform, (2) targeted participants who are students and practitioners of data science, criminology, or social work and professionals who work with RisCanvi. We also run focus groups with participants of the targeted study, including people who use RisCanvi in a professional capacity, to interpret the quantitative results. Among other findings, we observe that algorithmic support systematically leads to more accurate predictions from all participants, but that statistically significant gains are only seen in the performance of targeted participants with respect to that of crowdsourced participants. Among other comments, professional participants indicate that they would not foresee using a fully-automated system in criminal risk assessment, but do consider it valuable for training, standardization, and to fine-tune or double-check their predictions on particularly difficult cases. We found that the revised prediction by using a RAI increases the performance of all groups, while professionals show a better performance in general. And, a RAI can be considered for extending professional capacities and skills along their careers. (shrink)

El primer capítulo del libro The Varieties of Reference de Gareth Evans, denominado ‘Frege’, abre las puertas a nuevas perspectivas de análisis de la teoría fregeana. Este artículo tiene como objetivo revisar la interpretación que Evans presenta de la teoría semántica fregeana, analizar algunas de las consecuencias que se derivan de tal interpretación y proponer una versión de la teoría semántica fregeana que pueda dar cuenta de los casos problemáticos para el análisis de un lenguaje natural. El presente artículo está (...) dividido en dos partes generales: en los primeros ocho apartados se reconstruye y analiza el argumento de Evans; y en las conclusiones, se presenta un análisis de las conclusiones a las que llega Evans a partir de su argumento y una propuesta para hacer compatible el principio de composicionalidad y el principio de contexto en el marco fregeano con el fin de resolver algunos de los casos conflictivos para una teoría semántica fregeana para el lenguaje natural. The present article aims to present how the different philosophical perspectives have tackled the problem of the foundations of our responsibility to future generations in the context of ecological crisis. The main theories addressed here will be Hans Jonas metaphysical foundation, utilitarianism, communitarianism, the rights theory and contractarian perspectives derived from John Rawls’s theory. By assessing these perspectives, I assert that, against jonasianianism and related perspectives, our responsibilities to future generations must be thought of in terms of “political, not metaphysical”. The foundation of these responsibilities must be based, not on God, nor compassion, nor benevolence, nor identity sentiments, but on a conception of ourselves as rational and reasonable persons. From my point of view, we must find our responsibilities to future generations in our respect for their necessities and interests as well as in the maintenance of their available opportunities. This point of view allows us to point out some of our future challenges in the intergenerational justice scope. (shrink)

The extent to which machine metaphors are used in synthetic biology is striking. These metaphors contain a specific perspective on organisms as well as on scientific and technological progress. Expressions such as “genetically engineered machine”, “genetic circuit”, and “platform organism”, taken from the realms of electronic engineering, car manufacturing, and information technology, highlight specific aspects of the functioning of living beings while at the same time hiding others, such as evolutionary change and interdependencies in ecosystems. Since these latter aspects are (...) relevant for, for example, risk evaluation of uncontained uses of synthetic organisms, it is ethically imperative to resist the thrust of machine metaphors in this respect. In addition, from the perspective of the machine metaphor viewing an entity as a moral agent or patient becomes dubious. If one were to regard living beings, including humans, as machines, it becomes difficult to justify ascriptions of moral status. Finally, the machine metaphor reinforces beliefs in the potential of synthetic biology to play a decisive role in solving societal problems, and downplays the role of alternative technological, and social and political measures. The notion of the highest good used to occupy a primary role in ethical theorising, but has largely disappeared from the contemporary landscape. The notion was central to both Aristotle's and Kant's ethical theories, however--a surprising observation given that their approaches to ethics are commonly conceived as being diametrically opposed. The essays in this collection provide a comprehensive treatment of the highest good in Aristotle and Kant and show that, even though there are important differences in terms of content, there (...) are also important similarities in terms of the structural features of Aristotle's and Kant's value theories. By carefully analysing Aristotle's and Kant's theories of the highest good, a team of experts in the field shed light on their respective ethical theories and highlight the richness, complexity, and fruitfulness of the notion of the highest good. In natural kind debates, Boyd's famous Homeostatic Property Cluster theory (HPC) is often misconstrued in two ways: Not only is it thought to make for a normative standard for natural kinds, but also to require the homeostatic mechanisms underlying nomological property clusters to be uniform. My argument for the illegitimacy of both overgeneralizations, both on systematic as well as exegetical grounds, is based on the misconstrued view's failure to account for functional kinds in science. I illustrate the combination of these (...) two misconstruals with recent entries into the natural kind debate about emotions. Finally, I examine and reject Stich's "Kornblith-Devitt method" as a potential justification of these misconstruals. (shrink)

This paper reports research on the influence of corporate and individual characteristics on managers'' social orientation in Germany. The results indicate that mid-level managers expressed a significantly lower social orientation than low-level managers, and that job activity did not impact social orientation. Female respondents expressed a higher social orientation than male respondents. No impact of the political system origin (former East Germany versus former West Germany) on social orientation was shown. Overall, corporate position had a significantly higher impact on social (...) orientation than did the characteristics of the individuals surveyed. (shrink)

Without the maternal hold, without its herethical ethics and sublimation, without the stability that this hold can bring, we are melancholically or defensively driven to commit the most heinous acts of atrocity and violence in the name of eternal life, development, and progress. For the most part, Kristeva has described the combination of personal loss and social, cultural, and historical pressures brought to bear on the vexed sublimation of the maternal hold by artists like Giovanni Bellini. More recently, however, her (...) attention has turned to other contemporary examples, in particular, Max Beckmann whose works, she claims, sublimate the loss of the maternal hold itself. They are examples of a Sacred Family, a Pietà, or a Dormition that have undergone a radical transformation. They are representations of a society, a culture, indeed a world, that is losing its maternal hold; a world that is losing both its herethical ethics, and the capacity to sublimate its apoptotic inheritance. Following Kristeva, I will put Eduardo Lalo’s book of poems and drawings Necrópolis in a tradition of representation of the maternal hold that is close to a thousand years old. This tradition goes from the confrontation with nothingness in Theophane the Greek’s Dormition to the modern matricide represented in Pablo Picasso’s Maternity Apple. (shrink)

Plato's Philebus contains an intricate difficulty. Plato seems to hold both (a) that all pleasures are processes of becoming, a crucial premise in the argument that no pleasure is good (53c?55c) and (b) that some pleasures contribute in their own right to the goodness of the best life (64c?67b). Since it seems also plausible that only things which are good can contribute to the goodness of the best life in their own right, Plato's view seems to be inconsistent. Interpreters usually (...) reject either (a) or (b). As Plato seems firmly committed to both (a) and (b), I propose a third way of dealing with the inconsistency. The apparent inconsistency highlights a vital contrast between what is independently good (good per se), what is dependently good (good through participating in what is independently good), and what is derivatively good (good through standing in a certain relation to dependent goods). I argue that while pleasure's being a process of becoming marks it out as derivatively good, some kinds of pleasure are also dependent goods in virtue of their objects ? irrespective of their being processes of becoming. Sometimes he talks about his trips and the pleasure of being in touch with nature, he makes us feel as if we were with him in these different places. At other times he tells short stories, in such a way that only a very sensitive (...) person could do. He also reminds us of great historic moments and figures who are pointed out as examples. He contemplates present-day issues that are important, making an objective and independent analysis. All this diversity brings about a pleasant combination of texts that are carefully written and easy to read. Yet they stimulate the mind and provoke reflection.
